APPLICABLE FOR TRAVEL SERVICES PROVIDED BY MACKINNONS TRAVELS (PRIVATE) LIMITED

LEISURE TRAVELS

1. Most rooms and washrooms in hotels are moderate size.
2. Meals will be a mixture of local, Asian, and Indian but mostly local.
3. You will be travelling with a group and adhering to the times given by the guides or tour manager is mandatory as the program is designed as a strict time schedule. Anyone who continually gets late will have to be left behind, and they will have to find their own way to meet the group to continue with the rest of the tour.
4. All visa applications are subject to approval by the embassy, consulate, or the other applicable immigration authority. The decision of such authority shall be final and binding, and Mackinnons Travels (Pvt) Ltd (“MTL”) shall bear no responsibility or liability in that regard.
5. Visa fees are strictly non-refundable under any circumstances. In the event of a visa rejection, cancellation charges shall apply in accordance with the policies of the relevant airlines, hotels, and other third parties, unless expressly stated otherwise herein in writing.
6. The rates quoted above are based on a group fare. Therefore, all participants are required to travel as a group. No deviations from the itinerary shall be permitted without express written permission from MTL and any fare difference/penalties may apply.
7. All rates are calculated based on prevailing exchange rates and are subject to adjustment in the event of any increase in such exchange rates. Any applicable surcharges shall be determined at the time of booking and shall be borne by the participant.
8. Any cancellation of confirmed bookings shall be subject to the cancellation policy set forth herein. Hotel deposits and payments made to third parties are strictly non-refundable. In the event of cancellation or visa rejection, such deposits or payments shall not be refunded unless expressly stated otherwise herein in writing. Where such payments have been made by MTL on behalf of the participant, the participant shall promptly reimburse such amounts to MTL in full. In addition, the participant shall be liable to reimburse MTL for any cancellation fees charged by third parties, together with any handling, logistical, or other expenses incurred by MTL in connection with the booking.
9. Payments made in respect of any unutilized services or other components or activities included in the itinerary shall not be refunded.
10. The total cost of the confirmed tour must be borne and paid by the participant, i.e. the party confirming the booking, in respect of the participant and any other participants booking through such participant. MTL does not accept payments from third parties. Additionally, any external payments required to confirm the tour must be made in full by the participant prior to departure. MTL reserves the right not to process any reservations or bookings without receipt of total payment from the participant.
11. All participants are requested to obtain valid and adequate travel insurance covering the duration of their travel. Proof of such insurance may be requested prior to departure.
12. MTL shall not be held liable or responsible for any travel bans, restrictions, or prohibitions imposed on participants by governmental or regulatory authorities.
13. Participants hereby consent, on behalf of themselves and any other participants booking through them, to the processing of their personal data by MTL, its employees, agents, and sub-contractors, for the purposes of the tour, in accordance with the Personal Data Protection Act, No. 09 of 2022 of Sri Lanka and any other applicable data protection laws and regulations. 14. Participants shall participate in the tour at their own risk and shall have no legal impediments or other restrictions that would prevent or hinder their participation in the tour.
15. Hotels and other third parties reserve the right to charge the participant for any damage caused by any acts or omissions of the participant or their dependents, whether deliberate, reckless, negligent, or otherwise, and the participant shall bear such costs in full.
16. Participants acknowledge and agree that MTL shall not be liable for any Force Majeure Events and any consequences arising therefrom. A “Force Majeure Event” means any act of God, strike, lock out, threat of imminent strike, fire, flood, typhoon, cyclone, adverse weather, epidemic or pandemic, war, declared or undeclared, terrorism, insurrection, mob violence, governmental or regulatory action or requirement, law, failure of operation or equipment, or any other cause beyond MTL’s reasonable control.
17. Participants agree to indemnify and hold harmless MTL, its directors, employees, officers, and agents from and against any and all claims, liabilities, damages, losses, expenses, and consequences arising out of or in connection with any acts, omissions, negligence, misconduct, violation of laws, or breach of the terms and conditions of the Incentive Tour including these General Terms and Conditions by them or by any other participants booking through them.
18. Participants acknowledge and agree that the total aggregate liability of MTL, in any event, irrespective of the nature or form of the claim, shall at all times be strictly limited to the total amount paid by the participant to MTL in respect of the tour.
19. Please note that photos and videos may be taken during the tour for Mackinnons Travels’ marketing and promotional use. If you prefer not to be photographed or recorded, simply let Mackinnons Travels tour leader know before the tour begins.
20. Driving durations may vary based on weather conditions, traffic, and road conditions.
21. In most cities, coach parking is allocated in specific locations. Hence, passengers may have to walk from the bus parking area to tour starting points and restaurants.
22. This tour is not suitable for wheelchair passengers or anyone with difficulty in walking.
23. The quoted rates are based on a minimum of 15 paying passengers. In the unlikely event that the above given number is not met, the company holds the right to cancel this tour.

By joining the tour, participants acknowledge that they have carefully read, fully understood, and agreed to all the terms and conditions of this group tour including the General Terms and Conditions set forth above.

VISA SERVICES

1. All visa and related travel services are provided subject to the terms, conditions, and regulations of the respective Embassy, High Commission, Consulate, Immigration Authority, Visa Application Centre, and other relevant third-party service providers.
2. Visa approvals, documentation requirements, processing timelines, and appointment availability may vary depending on peak seasons, security clearances, public holidays, and operational procedures of the respective authorities.
3. The Visa Unit provides professional guidance and support throughout the visa application process. Visa approvals, processing timelines, and issuance outcomes remain under the discretion of the respective authorities.
4. Applicants are required to provide accurate, complete, and genuine documentation and information to support the visa application process.
5. Service fees, visa fees, and third-party charges will apply as per the applicable requirements and agreed service arrangements.
6. While every effort is made to facilitate a smooth and efficient process, entry approvals and final immigration decisions remain under the authority of the respective immigration and border control authorities.
7. All applicant information and documentation are handled with strict confidentiality and in accordance with applicable company policies and procedures.

By using the visa services, applicants acknowledge that they have carefully read, fully understood, and agreed to all the terms and conditions of this service including the General Terms and Conditions set forth above. They also acknowledge that these terms may differ by country and agree to consult the visa agent for specific terms and conditions.

CORPORATE TRAVEL

1. All travel services are provided subject to the terms and conditions of the respective airlines, hotels, and third-party suppliers.
2. Fares, availability, and rates are subject to change until confirmed and ticketed.
3. Changes, cancellations, refunds, and no-show policies are governed strictly by supplier rules.
4. Clients are responsible for ensuring compliance with passport, visa, transit, and health requirements.
5. Payments, service fees, and foreign exchange variations apply as per agreed corporate terms.
6. The company acts as an intermediary and is not liable for disruptions or changes caused by third-party suppliers or force majeure events.
7. All client data is handled confidentially and in accordance with applicable data protection laws.

By utilizing corporate travel services, clients acknowledge that they have carefully read, fully understood, and agreed to all the terms and conditions of this service including the General Terms and Conditions set forth above. They also acknowledge that these terms may differ by destination and services obtained and agree to consult their designated travel consultant for specific terms and conditions.
